Eco design is a digital platform to provide information and assist clothing, household linen and footwear brands to take up the eco-design challenge. This platform provides a common language and enables the eco-design approach to be co-built with as many people as possible.

These General Terms & Conditions are valid for all persons browsing the Site.
Article 1 – Definitions
The terms defined hereunder, when used within the General Terms & Conditions and the Personal Data Protection Policy in capital letters, whether in the singular or plural, shall have the following meaning:
“Access codes”: confidential password and login allowing Users to login into their Personal accounts.
“Personal account”: an account created by the User and in particular giving access to information and feedback.
“General Terms & Conditions” or “GTC”: all the stipulations stated in this document that define the rules for accessing and using the Site by the User.
“Personal data”: all information relating to an identified or identifiable individual, i.e., a person who can be directly or indirectly identified.
“Refashion portal”: the web platform edited by Refashion and accessible at the following address: https://refashion.fr/en, allowing internet users to select the site/extranet published by Refashion according to their profile.
“Products”: new clothing, footwear or household linen intended for domestic use placed onto the French market (mainland and overseas territories).
“GDPR”: EU regulation EU 2016/679 of the European Parliament and Council of 27 April 2016 on the protection of individuals in respect to the processing of personal data and free circulation of data.
“Site”: all services offered and information available on the internet accessible either via the Refashion portal or directly at the address https://refashion.fr/en
“Users”: all individuals browsing the Site.
Article 2 - Purpose
These General Terms & Conditions define the technical and legal conditions under which the User is authorised to:
Browse the Site and use its functionalities;
Create a personal account;
Access content provided by Refashion;
Communicate feedback to Refashion.
Article 3 – Compliance to General Terms & Conditions
These GTC come into effect on the date that they are published online and are binding for all Users.
Access to and use of the Site assumes beforehand that these GTC have been read, understood and accepted and that the legal provisions and regulations in force are met.
Under their sole responsibility Users can save or print these GTC by using their browser’s or computer’s standard functionalities.
Refashion recommends that Users print and keep a copy of these GTC for future reference.
Refashion reserves the right to modify these GTC at any time. These modifications are binding to the User as soon as they are published online. Consequently, it is recommended that the User regularly refers to these GTC in order to be familiar with any new conditions.
Each User shall carefully read these GTC as well as any successive versions, if applicable, before accessing any of the Site’s pages.
Article 4 – Description of the Site’s services
The Site’s main purpose is to enable a User to:
Benefit from privileged information about the CHF industry and its stakeholders (articles, videos, etc.):
Have access to the main tools and awareness-raising media about the CHF industry;
Know the CHF industry’s references, its situation at any given time, its stakes and challenges and its perspectives.
The Site enables the questions from Users to be answered and gives access to all fact sheets, initiatives and operational feedback.
These sections may be subject to changes depending upon Refashion editorial decisions.
Article 5 – Access to the Site/Personal Account
5.1 Methods to access the Site
The User can access the Site either by directly entering the Site’s address or via the Refashion portal then clicking on the https://refashion.fr/en tab.
If the User already has a Personal Account then only the User name and password need to be entered.
5.2 How to create a personal account
To create a personal account the User must have access to the internet and a valid email address allowing, in particular, an email to be sent to confirm registration.
The creation of a personal account allows a User to benefit from services offered by the Site and to access information about the CHF industry.
To create a personal account, the User must complete the information requested in the forms provided:
Personal user information: surname, first name and email address.
The name of the brand/manufacturer for who the User works.
Access codes are strictly personal and confidential. Users will be asked for these each time they login to their Personal Account. They shall not be communicated or shared with third parties.
If a User forgets his/her password, the User can generate a new password by clicking on “Forgotten your password?”. The User must enter the email address used when creating the Personal Account in order to receive a temporary link and reset the password.
In regards to Refashion and/or all other natural or legal persons, the User acknowledges that he/she is solely and exclusively responsible for the use of this login information by third parties or actions or statements made through his/her Personal Account, whether these be fraudulent or not, and guarantees Refashion against any requests in relation to this.
In order to ensure the Site’s security and prevent fraudulent intrusion by unauthorised persons, User passwords shall be comprised of at least 8 characters including numbers, letters and special characters. Users are requested to regularly change their passwords.
Users undertake to immediately inform Refashion of any unauthorised use of their Personal Accounts.
After having accessed his/her Personal Account, the User must logout by clicking on “Logout” so that no unauthorised person can access it. In this respect, Refashion invites Users to be careful, in particular when they login to their personal accounts from public terminals.
5.3 Security
A User’s Personal Account is an automated data processing system. All fraudulent access to it is prohibited and liable to prosecution.
Refashion undertakes to make its best efforts to make User Personal Accounts secure. However, in view of the complexity of the internet, it cannot guarantee total security. The User declares that he/she has accepted the nature and limits of the internet.
He acknowledges that he/she is aware of the nature of the internet network and in particular its technical performances and response times to visit, search for or transfer information data.
Users shall take all appropriate measures to protect their own data.
5.4 Closing a Personal Account by the User
The User may, at any time, close his/her Personal Account by sending a request to Refashion. The User will then receive a confirmation on the closure of his/her Personal Account to the email used for registration.
5.5 Closure of Personal Account by Refashion
In the event of use of the Site contrary to public order, accepted standards of good behaviour, or the law, as well as these GTC, Refashion may rightfully – without any prior notice and with immediate effect - delete a User’s Personal Account, without prejudice to any damages and compensation Refashion may be entitled to claim.
Article 6 – Rules for using the Site
During the creation of the User’s Personal Account, the User undertakes to supply correct and full information and to keep this updated without delay (in particular the list of his/her Principal).
When browsing the Site, the User shall not engage in acts of any nature whatsoever, which would be contrary to the Law, affect public order or the rights of Refashion or those of third parties. In particular, without being exhaustive, the User undertakes to comply with the following rules when browsing the Site:
Communicate correct information when registering and using the Site;
Update his/her information;
Not to use a false identity with a view to deceiving others;
Use the Site fairly in accordance with legal and regulatory provisions and current practices;
Comply to intellectual property rights of the contents provided by Refashion as well as those of third parties;
Not to divulge data, information or content that is defamatory, insulting, obscene, offensive, violent or inciting to violence, or of a political, racist or xenophobic nature and generally any content that would be in breach of the regulations in force or be contrary to accepted standards of good behaviour.
In the event of breach by a User of one or more of these rules, Refashion reserves the right to unilaterally suspend and/or delete the User’s Personal Account without any quid pro quo or duty to pay compensation of any kind.
Article 7 – Intellectual Property Rights
The Site, its content and all elements comprising it have been created by Refashion and as such Refashion owns all intellectual property rights.
Refashion owns the rights to use any of the Site’s elements, such as brand names, logos, texts, photographs and images, graphics, videos, sound and animated content, software, source codes, databases or for which it has the necessary licences related to intellectual property rights.
The User is hereby informed that the French semi-figurative trademark “Refashion” has been filed with the INPI (French National Institute for Intellectual Property) under number 3693276.
In this regard, any use of this trademark or any similar symbol is prohibited without prior, written consent from Refashion.
The User only benefits from non-exclusive and non-transferable rights of use for the Site and all elements comprising it.
Other than for private and non-exhaustive use, the User shall not reproduce and/or represent, download, sell, distribute, translate, adapt, communicate wholly or partially, under any form whatsoever, commercially or for any other purpose, the brands, original work or information contained on the Site.
The User shall not introduce data onto the Site that would modify or likely to modify in any way whatsoever the Site’s content, data display, presentation or organisation or works appearing on the Site.
Article 8 – Site Availability
Refashion shall not be held responsible for any voluntary or involuntary discontinuity in the Site’s availability.
Refashion also reserves the right to make the modifications or improvements to the Site that it considers necessary or useful for its good working order.
Refashion undertakes to make its best efforts to ensure that accessing, visiting and using the Site are secure in accordance with the rules of Internet use, in particular in regards to protection against viruses.
The Site shall be accessible 24 hours a day, 7 days a week except in cases of force majeure or an event outside of Refashion’s control and subject to possible failures affecting the Site and to all maintenance operations necessary to ensure its good working order. Without any prior warning or compensation, Refashion reserves the right to temporarily or permanently deny access to the Site in order to carry out updates and to modify or change operational methods and/or hours when the Site can be accessed. This list is not exhaustive.
The User declares that he/she has accepted the nature and limits of the internet, and in particular acknowledges that:
The use of the Site is under the sole responsibility of the User; the Site is accessible “as is” and according to its availability;
The User is solely accountable for all downloads and any eventual damage incurred by his/her computer and/or software and/or any loss of data following downloads or, more generally, visits to the website.
IIt is the User’s responsibility to take all necessary precautions to protect his/her own data and/or software against viruses that may travel via the Site;
The User shall have knowledge of the Internet’s nature, in particular its technical performances and response times required to visit, study or transfer information;
The communication of Access Codes or more generally any information considered to be confidential is under the sole responsibility of the User;
It is the User’s responsibility to take all necessary measures to ensure that the technical characteristics of his/her equipment allow the site to be visited and information to be downloaded.
Article 9 – Liability
Refashion may only be held liable by the User in the event of a proven fault and for direct consequential damages.
Refashion shall not be held liable for any breaches of these GTC by another user and, more generally, the infringement of Users’ rights.
It is the responsibility of the User to provide correct contact details whilst meeting Personal Data Protection regulations.
Refashion shall not be held liable:
for any nuisances or damages relating to the use of the internet, such as disruption to service, outside intrusion, presence of IT viruses or any other factor considered as a force majeure by the courts.
Nor shall it be held liable for any partial or total temporary inaccessibility to the Site.
For any disturbance in the use of the Site or breaches in IT security.
For any fraudulent or improper use or due to voluntary or involuntary disclosure to anyone of Access codes.
For breach of confidentiality of a User’s personal data by a third party resulting from these access codes, except for proven failure or negligence by Refashion.
For any breaches of the GDPR by the User.

Refashion collects and processes the Site Users’ personal data.

Article 13 – Applicable law - Disputes
13.1 Applicable law
These GTC are governed by French law. This is the case for both substantive and formal rules, notwithstanding the places of performance of substantial or ancillary obligations.
13.2 Competent Court
Any disputes arising out of these GTC shall be referred to the sole jurisdiction of the Courts within the competence of the Paris Court of Appeal, even in the event of proceedings involving several defendants.
