Which companies are liable? :

You are liable if you are a manufacturer or an instructing party (including up-cycling), an importer or a supplier. The marketer is the entity which brings goods into France if they are produced abroad, whether as an instructing party or an importer. For manufacturers, it is the manufacturer which uses his trademark which is responsible, whether goods are manufactured in France or abroad. If you buy goods from a French representative, but your purchase invoices come from abroad, you are also liable.

The articles liable were the focus of a notice published in the Official Journal of August 21, 2008. Articles include clothing, household linen (including curtains and net curtaining) and footwear: Download the list of products liable and excluded

To be concerned, products must:

  • Be destined towards the national and Dom-Com market : Guadeloupe, Martinique, Guyane, Reunion, Mayotte, Saint-Pierre-and-Miquelon, Saint-Martin;
  • Be destined towards households;
  • ​Be new.

Exported products (except Dom-Com) must not be declared.

Nb:
From 2020, curtains and net curtains are liable. They must be declared at the next call for fees.
